Client Terms & Conditions
Effective Date: 1 July 2026
These Terms & Conditions govern all services provided by Sue Kennedy ("we", "our", "us") to the client ("you", "your"). By engaging our services, accepting a proposal, paying an invoice or requesting work to commence, you agree to these Terms & Conditions.
1. Services
Services may include, but are not limited to:
- Authority Book Strategy
- Book Coaching
- Manuscript Development
- Structural Editing
- Copy Editing
- Proofreading
- Publishing Guidance
- Interior Book Formatting
- eBook Formatting
- Cover Design Coordination
- Print Production Support
- Print File Preparation
- ISBN and Barcode Assistance
- Publishing Consultation
- Marketing Strategy relating to books
The exact scope of work will be outlined in your proposal, invoice or written agreement.
2. Scope of Work
Only the services specifically included in your proposal or written agreement are included.
Any additional work requested after commencement may incur additional fees.
Examples include:
- additional editing
- rewriting
- extra formatting
- additional revisions
- content changes
- replacing images
- new chapters
- redesigning layouts
- preparing additional file formats
- additional print-ready files
3. Client Responsibilities
You agree to:
- provide complete and accurate information
- supply final manuscript files unless editing has been engaged
- provide high-quality images where required
- obtain copyright permission for all supplied material
- ensure all information supplied is lawful and accurate
- respond promptly to requests for information or approvals.
Delays in providing information may result in revised delivery dates.
4. Ownership of Content
You retain ownership of your manuscript and any material you provide.
You warrant that you own, or have permission to use, all text, photographs, illustrations, trademarks and other material supplied.
You indemnify Sue Kennedy against any claims arising from copyright infringement or unauthorised use of materials supplied by you.
5. Proofs and Client Approval
Drafts and proofs are supplied for your review before final delivery.
It is your responsibility to carefully review every page of every proof.
This includes checking:
- spelling
- grammar
- punctuation
- page numbering
- chapter order
- image placement
- captions
- headings
- hyperlinks
- table of contents
- index
- margins
- layout
- formatting
- cover text
- barcode
- ISBN
- author biography
- acknowledgements
- front matter
- back matter
- print specifications
Written approval (including email approval) constitutes acceptance of the work.
Once approval has been received:
- the files are considered final;
- work may proceed to publication, printing or delivery;
- responsibility for approved content transfers to the client.
Any changes requested after approval will be treated as a new piece of work and charged at our current rates.
Sue Kennedy is not responsible for errors, omissions or alterations that were present in an approved proof.
6. Revisions
Unless otherwise stated in your proposal, reasonable revisions are included during the agreed review stage.
Revisions do not include:
- changing the direction of the project
- rewriting completed work
- significant manuscript additions
- major design changes
- replacing large amounts of content after formatting has commenced.
Additional revisions will be quoted separately.
7. Editing Services
Editing improves clarity, readability and consistency.
Editing does not guarantee that every error will be identified.
Clients remain responsible for reviewing and approving all edited material before publication.
8. Formatting Services
Formatting is completed using professional publishing standards suitable for the intended print or digital platform.
Minor differences in appearance may occur between software, operating systems, eReaders, printers and print providers.
Sue Kennedy is not responsible for differences caused by third-party software, printing equipment or publishing platforms.
9. Printing
Where print production assistance is provided, Sue Kennedy acts as an advisor and coordinator unless otherwise agreed.
Final responsibility for approving print files rests with the client.
Printing variations, including colour, trimming, paper stock, binding and finishing, are the responsibility of the printing provider once files have been approved.
10. Publishing Platforms
Where assistance is provided with publishing platforms such as Amazon KDP, IngramSpark or other distributors, Sue Kennedy cannot guarantee approval, acceptance or continued availability of those platforms.
Platform requirements may change without notice.
11. Results
Every book project is unique.
We do not guarantee:
- book sales
- bestseller status
- media coverage
- speaking opportunities
- business growth
- client enquiries
- financial outcomes
- publishing success.
Success depends on many factors outside our control.
12. Fees and Payments
Invoices are payable by the due date stated.
Work may not commence until any required deposit has been received.
Final files will generally not be released until outstanding invoices have been paid.
Late payments may delay project completion.
13. Project Delays
Where a client becomes unresponsive for more than 60 days, the project may be placed on hold.
Projects inactive for more than six months may require a new quotation before work recommences.
14. Cancellation
If you choose to cancel a project after work has commenced, payment is required for all work completed up to the cancellation date.
Deposits are non-refundable unless otherwise agreed.
15. Limitation of Liability
To the fullest extent permitted by law, Sue Kennedy's liability is limited to the value of the services supplied.
Where liability cannot legally be excluded under Australian Consumer Law, our liability is limited to re-supplying the services or paying the reasonable cost of having those services supplied again.
Sue Kennedy is not liable for indirect, consequential or financial losses arising from the use of completed work.
16. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee or other right that cannot legally be excluded under the Australian Consumer Law.
17. Confidentiality
All client manuscripts, business information and unpublished material will be treated as confidential unless disclosure is required by law or authorised by the client.
18. Portfolio Rights
Unless otherwise agreed in writing, Sue Kennedy may refer to completed projects in portfolios, case studies, social media or marketing once the book has been publicly released.
No confidential or unpublished material will be shared before publication without your permission.
19. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Any disputes shall be subject to the jurisdiction of the courts of New South Wales.
